Tarrio Attorney: Feds Illegally Refusing to Hand Over Evidence that Could Exonerate Proud Boys

Text messages and emails that might help exonerate Enrique Tarrio and four other men are being illegally withheld by Federal Prosecutors, according to an August 1 motion filed by Tarrio’s attorney. The five men, members of the Patriotic Proud Boys Fraternity, participated in the Save America rally on January 6, 2021, protesting the 2020 Presidential election results. According to the motion, Federal prosecutors are refusing to produce evidence which could “effect the outcome of the trial”. The material includes correspondence between the Proud Boys and law enforcement prior to rallies in Portland and Washington, DC. Tarrio’s Attorney, Nayib Hassan says communicating with Law Enforcement prior to rallies attended by the Proud Boys is “standard operating procedure”. (Note: Prior to the dozen or so rallies I organized opposing mask and vaccine mandates, I always communicated with Law Enforcement about our plan, if we were marching, how many people were expected and if we required their assistance. To not notify them is both stupid and disrespectful.)

    Enrique Tarrio and Joe Biggs are both being held without bail. Tarrio was not at the Capitol on January 6.

    The U.S. Supreme Court ruled in Brady v. Maryland that “The government's withholding of evidence that is material to the determination of either guilt or punishment of a criminal defendant violates the defendant's constitutional right to due process.“ With Brady, the burden falls on the Government to obtain and produce the requested evidence, in this case correspondence between the Proud Boys and Law Enforcement. According to the brief, the Government produced correspondence from Defendant Joe Biggs to Portland Police detailing the intended locations and intended route of a demonstration and shows the Proud Boys “stayed true to their stated intentions.” Correspondence between the Proud Boys and Metro DC Police prior to eight rallies the group attended in Washington, D.C. between 2019-2021, including January 6, could show a pattern of consistently following through with their stated intentions and shed light on what Capitol Police were communicating to the Proud Boys that day regarding the demonstration. So far, the Federal Government’s entire case hinges on bits of Telegram chats between Tarrio and the Proud Boys and they are refusing to hand over the requested messages.

    Ethan Nordean, Joseph Biggs, Zachary Rehl, Dominic Pezzola and Tarrio, who was not present at the Capitol on January 6 are charged with Conspiracy to Obstruct an Official Proceeding, Obstruction of an Official Proceeding, Obstruction of Law Enforcement During a Civil Disorder, Destruction of Government Property, and Assaulting, Resisting, or Impeding Certain Officers. Read the indictment here. Thereafter, the Government filed a Third Superseding Indictment charging all five men with a new allegation of Seditious Conspiracy. Read the second indictment here. If found guilty they face decades in Federal Prison. Hassan argues that Tarrio’s Constitutional Rights are being violated and in spite of multiple attempts to obtain the requested Brady documents, to date nothing has been provided.

    The Demonstration on January 6 became deadly when a group of protestors broke off from the Save America rally and assembled outside the US Capitol. Some entered the building after gaining permission from Capitol police, who opened the doors for them. Combat Veteran Ashli Babbit, who was shot and killed by Capitol Police Lieutenant Michael Byrd and Roseanne Boyland, who died from injuries sustained after Capitol Police began attacking demonstrators with batons and firing pepper spray canisters into the crowd, are two of the casualties. The January 6 Select Committee has been allowed present a one sided narrative on Prime Time television over the last two months, convicting Tarrio and others in the public eye without the benefit of defense. All five defendants will go on trial in Washington, D.C. on December 12. Tarrio’s attorney has argued there is no possibility of a fair trial in the Nation’s Capitol, who’s Justice System leans hard Left.

    Tarrio’s parents escaped Communist Cuba after Che Guevara’s military force shot four members of their family execution style when they refused to turn over the family farm.
